  • I, * , HEREBY ENTER INTO THIS MEETING ROOM USE AGREEMENT ("AGREEMENT") WITH THE PLAINFIELD-GUILFORD TOWNSHIP PUBLIC LIBRARY (the 'LIBRARY") FOR THE USE OF A MEETING ROOM HAVING FULLY READ AND UNDERSTOOD ALL POLICIES, RULES AND REGULATIONS GOVERNING THE USE OF THE MEETING ROOM ATTACHED TO THIS AGREEMENT. (SEE ATTACHED EXHIBITS A-E)

    I AGREE THAT I AM RESPONSIBLE FOR FULL COMPLIANCE WITH ALL LIBRARY POLICIES, RULES AND REGULATIONS RELATING TO THE USE OF MEETING ROOMS AND ASSUME SOLE RESPONSIBILITY FOR THE CONDUCT OF ANY ATTENDEE AT THE SUBJECT EVENT OR MEETING.

    I ACKNOWLEDGE THAT AS THE PERSON SIGNING THIS AGREEMENT I WILL BE HELD PERSONALLY RESPONSIBLE FOR ANY DAMAGE OCCURRING AS A RESULT, OR ARISING OUT OF, USE OF MEETING ROOMS BY MY GROUP OR ORGANIZATION.

    I AGREE TO HOLD THE LIBRARY HARMLESS FROM ANY AND ALL LIABILITY, CLAIMS, SUITS, ACTIONS, DEBTS, DAMAGES, COSTS, CHARGES, AND EXPENSES, INCLUDING COURT COSTS AND ATTORNEYS FEES, AND ALL LIABILITY, LOSSES OR DAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF THE USE THE MEETING ROOM.

    I UNDERSTAND THAT THE LIBRARY, THE LIBRARY DIRECTOR OR DESIGNATED REPRESENTATIVE OR THE BOARD OF TRUSTEES MAY CANCEL MY USE OF THE MEETING ROOM IF I OR MY GROUP DO NOT COMPLY WITH THE TERMS OF THIS AGREEMENT AND THE POLICIES, RULES AND REGULATIONS ATTACHED HERETO.

      The Plainfield-Guilford Township Public Library (“Library”) provides access to resources supporting the informational, educational, recreational, and cultural needs and interests of its constituents in a financially responsible manner. Within this framework, the Library offers meeting room space on a fair and equitable basis in accordance with this policy.


      Use of Library meeting rooms by any group or individual signifies acceptance of and intent to comply with the terms and conditions set forth in this policy.

      A. Eligibility and Fees


      Businesses, residents, and organizations within Guilford Township engaged in advocacy, social services or whose activities are of a charitable, civic, commercial, cultural, educational, governmental, intellectual, political, or religious nature are eligible to use the meeting rooms free of charge. 

      Local, county, state, and federal government agencies or organizations, officials, or contracted parties who serve or represent Guilford Township and its residents may use the meeting rooms free of charge. 

      Non-profit organizations located within Hendricks County are eligible to use the meeting rooms free of charge. Proof of IRS 501(c)(3) status may be required.

      All other businesses, individuals, and organizations who reside outside of or who do not have a physical location within Guilford Township may access the meeting rooms for a fee of $50 per use.

      B. General Guidelines   


      Library programs, activities, and related events have priority over all other meeting room uses and may be granted specific exceptions to the terms and conditions of this policy at the sole discretion of the Library Director.

      Meeting rooms are available during normal operating hours. Meeting room users will not be permitted entry into the building outside of operating hours except at the sole discretion of the Library Director. Specific exception to this clause is made for election officials, poll workers, and voters when the Library serves as a polling location during general and primary elections.

      Meeting rooms may not be scheduled for days when the Library is closed. The Library reserves the right to restrict or limit the use of meeting rooms during primary and general elections when the Library serves as a polling location.

      Meeting room users must ensure that any outside equipment or technology intended for use in the meeting room is compatible with the existing technical and audiovisual capabilities present in the meeting rooms. The Library can not guarantee technical support for outside equipment or technology brought in for use in meeting rooms.

      Meeting room users and attendees must adhere to all established Library policies, rules, and regulations. In particular, meeting room users should review the library’s Courtesy Policy, the Children in the Library Policy, and the Petitions, Electioneering, and Leafleting Policy.  Further, the Library Director or designated representative, is authorized to deny the use of meeting rooms to any group or individual that engages in conduct in violation of the Library's established policies, rules and regulations, or has a history of engaging in other disorderly, disruptive or abusive conduct.  Users who misrepresent an event to avoid compliance with the Library's established policies, rules and regulations may have reservation privileges suspended.  

      Use of the meeting rooms must not interfere with or disrupt normal Library operations or the use of the Library by others. The Library reserves the right to immediately terminate meetings that cause disruption or disturbance in contravention of its established policies, rules and regulations.  The Library reserves the right to have a designated staff member present at any meeting, program, or event to ensure adherence to its policies, rules and regulations regarding appropriate use of meeting rooms.  

      Meeting room users must vacate the meeting rooms at least  five (5) minutes prior to the Library closing.  Meeting room users whose meeting runs past closing time or who otherwise fail to vacate the building on time may have their meeting room privileges suspended or terminated.  

      Permission to meet at the Library does not, in any way, represent or imply approval or endorsement by the Library, its staff, or the Library Board of Trustees of a particular group or individual, their point of view, or the thoughts, ideas and opinions expressed during the meeting.

      Meeting rooms are available for both public and private use.

      No meeting room user may charge an admission fee nor may they solicit or collect a “free will” offering, nor may they sell or present for sale any item which is conditional for attendance. However, the selling of products or services is permitted under the terms of the library’s Courtesy Policy.

      Except for the Friends of the Plainfield-Guilford Township Public Library, no group or individual may use the name of the Library, its address or telephone number as either their contact information or their headquarters location. 

      The Library's logo cannot be used on advertisements or announcements.  Groups and individuals may not imply the Library's sponsorship or endorsement of the meeting or other activity being held on Library property.  The Library's name may only be used in reference to the meeting location.  

      The Library will not create or prepare any publicity, marketing, or advertising materials for meeting room users. Posting of such materials by meeting room users is governed by the terms and conditions of the Library’s Community Notice Board Policy.

      Meetings will be canceled if the Library is closed for weather or any other emergency. Meeting room users will not be directly notified in the event of an emergency closure. Weather related closures are announced through broadcast and social media in addition to the Library’s website. Other closures may only be announced by signage posted at the main entrance.

      Meeting room assignments will be made and may be changed, without notice, at the discretion of Library staff. 

      Minors aged nine (9) - seventeen (17) should not be left in meeting room spaces unattended. 

      Caregivers or parents using the meeting room spaces must directly supervise children eight (8) years of age or younger at all times in accordance with the Library’s Children in the Library Policy.

      The Library does not provide storage for any equipment, materials, or supplies used by meeting room users. Specific exception is made for the storage of voting equipment in preparation for elections.

      Use of meeting rooms does not imply endorsement, support, or co-sponsorship by the Library for any activities that take place in the meeting rooms nor the beliefs or views of any group sponsoring an event.  Any user of meeting rooms which is unaffiliated with the Library or its programming, must include a disclaimer in any promotion or other notice of the meeting or event that the meeting or event is neither sponsored by nor endorsed by the Plainfield-Guilford Township Public Library.

       

       C. Reservations


      Reservations must be made by an adult of at least eighteen (18) years of age. This individual will be responsible for the group using the meeting room and will be held financially accountable for any resulting loss or damage.    

      Reservations will not be made more than ninety (90) days in advance in order to prioritize library events, programming, or other library related scheduling needs. Specific exceptions to this clause may be made at the sole discretion of the Library Director. Reservations are considered on a first come, first served basis.

      Meeting room users are solely responsible for submitting their requests in a timely manner. The Library will not retain lists of future bookings for later inclusion in the booking system. 

      The Library does not offer standing reservations to meeting room users. 

      Meeting room requests may be made in person, over the phone, on the Library’s website, or via email through the rooms@plainfieldlibrary.net email address.

      Meeting room users must complete an online Meeting Room Use Agreement acknowledging acceptance of the terms and conditions for use of the Library meeting room space. Reservation requests will not be confirmed until the online Meeting Room Use Agreement  has been properly executed and received. For purposes of efficient recordkeeping, the library no longer uses paper forms.

      For reservations where payment is due, the reservation will not be confirmed until payment has been received.

      The Library reserves the right to impose limits on the number and frequency of meeting room reservations. Any meeting room reservation that would unduly limit, restrict, monopolize, or otherwise prevent equitable access to other meeting room users is strictly prohibited.    

      Meeting room users must provide a notice of cancellation no later than 24 hours prior to the scheduled meeting. Failure to provide proper notice may result in the cancellation or denial of future bookings.

      Meeting room reservations are non-transferable; any meeting room users who engage in this practice will have their meeting room privileges revoked.

       
      D. Care and Use of Facilities


      The Library does not provide staff to assist meeting room users with room set up or clean up. 

      Meeting room users may not attach items to interior or exterior surfaces throughout the Library. 

      Meeting room users assume full responsibility and may be financially accountable for any damages or losses incurred resulting from the use of the meeting rooms. Abuse of the facilities will be sufficient cause to deny further use of meeting room spaces.

      The Library is not responsible for the safety and security of personal items.

      Light refreshments, including beverages, snacks, and boxed or bag lunches may be served.  Alcoholic beverages are not permitted.

      Meeting room users are responsible for cleaning up after their meetings and properly disposing of trash. This includes wiping off tables and chairs and sweeping the floor with the cleaning supplies provided in each meeting room.

      Meeting rooms must be left as they are found. If furniture is rearranged, it must be returned to the default arrangement as indicated on the posted diagram in each room.

      The use of tobacco products, including vaping devices, are not permitted. 

      E. Room Capacity


      Meeting room users must adhere to the posted maximum occupancy limits of each room and are responsible for enforcing occupancy limits for their meetings. The Library reserves the right to terminate meetings where posted occupancy limits are exceeded and may suspend or terminate meeting room privileges for the groups who exceed posted limits.

      F. Indemnification Clause


      Meeting room users will indemnify and hold harmless the Library, its Board of Trustees, the Library Director, and all Library staff members and volunteers, from any loss, damages, liability, costs and/or expense that may arise during or out of an event in any way by use of the Library's meeting rooms or other facilities with the exception of loss, damage, liability, costs and/or expense caused as a result of the willful act or negligence of the Library.

      The individual reserving the meeting room and/or completing a meeting room agreement assumes all responsibility for the preservation of order and for any injury to persons, and damage to, or loss of property that may result from the use of the meeting rooms other than for injury or damage caused by the willful act or negligence of the Library; and for observance of all established policies, rules, and regulations of the Library 

      Meeting room users may be required to sign additional waivers and releases as a condition of using the meeting room space. This will be determined on a case by case basis.

      G. Appeals


      Meeting room decisions may be appealed, in writing, to the Library Director within ten (10) days of the disputed action. The Library Director will issue a final determination, in writing, within a reasonable amount of time not to exceed thirty (30) days.

      The Plainfield-Guilford Township Public Library is committed to providing a welcoming environment so all visitors can enjoy the library. We ask that everyone be courteous and respect other visitors, library staff, and facilities by showing appropriate behavior and by refraining from inappropriate actions that disrupt or detract from others' use and enjoyment of the library. 


      Such inappropriate actions include, but are not limited to, the following:


      Any illegal activity;
      Possession of weapons except as permitted by law;
      Any form of sexual misconduct, exposure, or offensive touching;
      Being under the influence of or in possession of alcohol or any other illegal substance;
      Harassment or abuse of any kind toward staff and library users;
      Threatening or intimidating staff or library users in any way;
      Engaging staff in excessive conversation, stalking, or lingering at public service desks;
      Engaging in disruptive behavior or causing a disturbance;
      Loitering on library property;
      Being in the library before or after business hours;
      Entering staff work areas;
      Using tobacco or vaping products in the library or within close proximity of entrances;
      Damaging, misusing, or monopolizing library property, equipment or materials; 
      Selling or soliciting on library property without prior approval from Library Administration; 
      Petitioning, electioneering, or distributing leaflets or other materials inside the library;
      Panhandling on library property;
      Distributing or posting printed materials without prior Library Director approval;
      Bringing in animals except service animals without prior Library Director approval;
      Improperly using restrooms;
      Serving food in public areas;
      Using bicycles, rollerblades, skateboards, scooters, etc. in the library;
      Blocking aisles, entrances, and exits;
      Not wearing shoes or a shirt; wearing cleats or bathing suits;
      Having offensive bodily hygiene so as to be a nuisance to others;
      Violating established library rules, regulations, policies, procedures, or guidelines

      Posting, Enforcement and Appeal

      This policy will be posted conspicuously throughout the library and on the library website.  All library staff are responsible for enforcement. Individuals violating the policy will be given sufficient opportunity to take corrective action before being asked to leave the premises. Law enforcement may be called to assist in the removal of uncooperative individuals. Trespass warrants may be issued by police barring individuals  from the library for a specific amount of time. Library patrons may submit a written petition to the Library Director for review of any sanction imposed by library staff. Sanctions imposed by the Library Director may be appealed in writing to the Library Board.

      The Plainfield-Guilford Township Public Library welcomes and encourages children and families to use and enjoy the library and its services to the fullest extent. While visiting, it is important to keep in mind that while we strive to create a welcoming environment, the library is still a public place open to anyone and everyone. As such, responsible parties such as parents, grandparents, legal guardians, custodians, and caregivers must ensure the safety and well being of their charges at all times and must directly supervise children eight years of age or younger while in the library and on library property. Library staff can not assume the responsibility of supervising children nor are they responsible if unattended children of any age leave library property alone or with others. 


      For the purpose of this policy, the terms “custodian” and “caregiver” refer to an individual twelve (12) years of age or older who is charged with the responsibility of supervising a child or children. Furthermore, the library establishes twelve (12) as the minimum age in which an individual is able to properly supervise children eight years of age or younger.


      Children eight years of age and younger:

      Must be supervised at all times by a responsible party 12 years of age or older and must follow library rules, regulations, and policies;
      Supervision is defined as being actively engaged with and located within the immediate vicinity of and within visual contact of the child or children;
      The library in no way assumes responsibility for any child eight or younger left unsupervised on library property;
      If a child in this age group is found unsupervised, library staff will attempt to locate the responsible party in the library and present them with this policy;
      In the event a responsible party can not be located, staff will contact law enforcement.

      Children nine to seventeen years of age:

      Children must follow library rules, regulations, and policies;
      The library in no way assumes responsibility for unattended children on library property;
      Staff are not responsible for children asked to leave the library for policy violations;
      Children must be picked up by closing time;
      Law enforcement may be called for children not picked up within 15 minutes of closing.

      Under no circumstance are library staff permitted to give children rides, allow them in their vehicle, or leave library property with them. Two library employees must stay with the child until either law enforcement or a responsible party arrives to take charge of the child.


      The library is a mandatory reporting agency under state statute; repeat offenders of this policy as well as other situations of suspected abuse and/or neglect will be reported to the Indiana Department of Child Services.

      The Plainfield-Guilford Township Public Library has the authority to make reasonable rules that are universally applicable regarding the allowed use of library buildings and property, including content-neutral restriction of conduct involving passing out literature and the collection of signatures for petitions. The sidewalks around the library are a traditional public forum subject to reasonable time, place, and manner restrictions on those wishing to use them for purposes protected by the First Amendment of the United States Constitution. As such, the library allows people to circulate petitions, electioneer for political candidates, and distribute literature outside library facilities subject to the following rules and regulations:


      Persons circulating petitions for signatures, electioneering for political candidates, or leafleting may stand on library property; however, they may not engage in collecting signatures, electioneering activity or distributing leaflets inside the library building.
      Electioneering for political candidates is limited to the dates and times that the library serves as an active polling location. 
      Campaign materials and signs may be displayed by political candidates on library property only on an election day when the library is used as a polling place subject to legal guidelines governing such displays.
      Petition circulating, electioneering or leafleting must take place outside the library building at least twenty feet (20’) from entrances and exits.
      Persons circulating petitions, electioneering for political candidates, or leafleting shall not block, hinder, interfere, or otherwise impede patrons and staff wishing to enter or exit the library building or to use book returns, nor seek to intimidate, pressure or harass patrons or staff into signing a petition, accepting electioneering materials, or accepting a leaflet.
      Persons circulating petitions, electioneering, or leafleting shall not occupy areas designated as fire or emergency lanes and shall not occupy parking spaces.
      The use of sound amplification equipment or methods is prohibited.
      No monies or donations can be collected, solicited, or accepted.
      Persons circulating petitions, electioneering, or leafleting are not permitted to erect tables, chairs, or affix signs to library property.
      Only one person at a time is permitted to solicit signatures for a single petition, electioneer for a single political candidate, or distribute leaflets.
      No leafleting or distribution of literature, or solicitation is permitted for the purposes of selling items, merchandise, tickets, or other for-profit activities.
      Panhandling is not permitted on library property.
       Any person wishing to solicit signatures for a petition or leaflet shall inform Library Administration in advance of their desire and intent to solicit signatures for a petition or to distribute leaflets. Each such individual shall provide their name, address, and a copy of the petition or leaflet to Library Administration.
      Library Staff, Friends of the Library, and members of the Library Board of Trustees are exempt from the above constraints in promoting library activities and issues.

      Persons who fail to comply with this and other general library policies or with any of the above rules and regulations will be asked to leave the library premises and may be barred from the right to circulate petitions or distribute leaflets in the future.


      The Library will not assume responsibility for any harm or injury suffered by persons circulating petitions, electioneering for candidates, or distributing leaflets, or by those who are signing a petition or by receiving electioneering materials or leaflets.


      The presence of persons circulating petitions, electioneering for candidates, or distributing leaflets outside the library does not constitute the Library’s endorsement of any candidate, nor does it constitute support or opposition of the subject matter of any petition or leaflet.


      The presence of a person circulating petitions, electioneering materials, or leaflets outside the library does not constitute the Library’s endorsement of the policies, beliefs, or political affiliations of any person or group circulating such petitions, electioneering materials, or leaflets.

      The Plainfield-Guilford Township Public Library provides a designated space for the posting and display of community notices. Notices are not permitted at public desks or at other locations throughout the library.

       

      General Guidelines for Notices:


      All notices must be approved in advance by the Library Director or their designee.
      All notices will be dated and initialed by library staff before posting.
      All notices will be posted using an acrylic hanger.
      Notices should be submitted to the Information Desk or via email at askus@plainfieldlibrary.net.
      Submitted notices become the property of the Library and will not be returned whether the notice is approved for posting or not.
      Priority will be given to Library related information or events.
      Unauthorized postings or postings that have been defaced or damaged will be removed.
      Notices must be objective in nature, reflect accurate information, and be legible.
      Notices should not be or include defamatory or other inflammatory material.
      Partisan political signs and commercial advertising notices are not permitted.
      Notices will be removed 30 days from date of posting or after the conclusion of the advertised event, whichever comes first.
      Notices should be one of these standard sizes: 8.5” x 11”, 8.5” x 14”, or 11” x 17”.
      Hand-written or poorly constructed notices or those with tear offs will not be accepted.
      Notices that violate established library policies will not be posted.

      The Library does not advocate or endorse the viewpoints of any particular group, meeting, or idea presented in community literature posted on the community notice board.


      The Library reserves the right to remove postings at any time and at its sole discretion.


      All notices are posted at the risk of the person or group, and the Library bears no responsibility for damage, defacement, or unauthorized removal from the Community Notice board.


      Any notice that does not meet the above stated guidelines will not be displayed and/or may be removed.
